Signing a power of attorney form prevents family strife

Although many of us are concerned about our futures when we are elderly and frail, most of us have not established contingency plans in case we cannot provide for ourselves.

59%, or approximately 3.4 million individuals aged 75 and older, still need to establish a power of attorney (POA) to manage their health and finances if they cannot do so themselves, according to research conducted by investor relations firm Just Group.

“No one likes to consider their vulnerabilities or impending mental and physical decline,” says Stephen Lowe, director of group communications at the firm. “However, managing the affairs of a relative without a power of attorney in place can be distressing and expensive.”

A power of attorney is a legally binding document that designates and authorizes a trusted individual, referred to as the “attorney,” to assume control of one’s affairs in the event of future incapacity. On your behalf, your attorney can handle medical decisions, banking, tax obligations, and legal matters.

Family members, acquaintances, and even your spouse may be able to carry out your wishes with a power of attorney because institutions will not grant them access to your accounts or the authority to make decisions on your behalf.

It can only be recorded during the individual’s mental faculties. “We should prepare for the worst, even though we can only hope for the best,” advises Rachael Gryphon, a wealth manager Quilter tax and financial planning specialist.

If something happens to you without a POA, a family member or companion must petition the Court of Protection for appointment as your “deputy.”

Understanding Types of Power of Attorney

This may take four to six months, and you must pay approximately £800 and an additional £1000 for solicitor’s fees. An order for a hearing by the court may result in increased expenses.

The prevailing power of attorney is the Lasting Power of Attorney, formerly an Enduring Power of Attorney until 2007. This confers upon your attorney the power to assume control of your affairs if you experience a loss of mental capacity. The alternative is an Ordinary Power of Attorney, which confers temporary authority over one’s affairs to another individual, typically in situations such as hospitalization or international relocation.

You may execute a Lasting Power of Attorney (LPA) in two domains. One is for your financial and property protection, while the other is for your health and welfare. To be completely ready for the future, two LPAs should be in place, one for each area.

“They will possess extensive authority to act and decide your affairs like you would.” It is not mandatory to identify your family members; instead, you may choose any individual with whom you have complete faith. Additionally, the same solicitors are not required to draft both documents. The representation of one’s health and welfare may be entrusted to a distinct individual rather than one’s property and finances.

Challenges in DIY Power of Attorney

Consider the age of your solicitors as well. Can one ascertain with certainty whether an individual of comparable age to oneself will retain mental capacity when the time comes when one requires their assistance?

The requisite registration forms can be obtained from Gov. UK for a fee of £82 per type; one is designated for health and wellbeing, while the other is for finances and property.

Individuals who earn £12,000 or less before taxes are eligible for a 50% reduction on the charge. Register them with the Office of the Public Guardian once completed. Typically, the registration process for an application requires approximately four months.

“I established a power of attorney for my father; it was straightforward and much less expensive than hiring a lawyer,” says Amanda Elias, 43, founder of Bravura Cosmeceuticals in Ammanford, South Wales, and mother of three. Completing it requires a few months, after which you can activate it online whenever necessary.

Nevertheless, numerous do-it-yourself forms need to be completed more accurately. Nearly 130,000 applications for Lasting Power of Attorney were denied by the Office of the Public Guardian between 2018 and 2023, according to Freedom of Information data from Quilter.

The prevailing cause for rejection was the incorrect sequencing of signatures on the forms. Other problems included omissions of information, omissions of full names, and inaccurate witness statements; you may only use someone related to you, the counsel, or in a situation with a potential conflict of interest.

Crafting Effective Power of Attorney

Whether drafting documents for a durable power of attorney yourself or with the assistance of a lawyer, be sure to include any pertinent additional information. For instance, do you need the help of an investment manager with your finances? If so, it could be beneficial to stipulate in your LPA that you authorize your attorney to maintain their use.

“Without professional guidance, the majority of solicitors lack the knowledge and expertise to invest the assets of a family member,” says Rebecca Seeley Harris, a solicitor at Re Legal Consulting. In the past, the Office of the Public Guardian (OPG) mandated designated language in the Lasting Power of Attorney to authorize the attorney to grant authority to an investment manager for investment decisions. Although this stipulation has been eliminated, “certain financial institutions may continue to demand it.”

Seeley Harris further states, “This is not the first time that financial institutions have disregarded the OPG; they have also disregarded the new digital service and continue to require paper documents.”

This is why it is frequently advisable to seek the assistance of a solicitor. The cost to retain a lawyer ranges from £500 to £700 per power of attorney form. However, numerous providers will provide you with a discount if you establish financial and health power of attorney simultaneously. Additionally, you may qualify for a discounted rate if you set up power of attorney and update or draft your will simultaneously.
