His attorney characterises former film producer Harvey Weinstein’s condition as “a train wreck” as he undergoes diagnostic procedures in a New York hospital. The news arrives days after the reversal of one of his rape convictions.
The attorney for Harvey Weinstein reports that the ex-film producer was transported to the hospital after being transferred to a New York jail.
It occurs days after a New York court overturned the movie mogul’s rape conviction in 2020 and ordered a new trial in the landmark “MeToo” case.
Arthur Aidala, Weinstein’s attorney, stated that his client was transferred to Bellevue Hospital in Manhattan for examinations following his Friday arrival at a prison in New York City.
After examining him, he was transferred to Bellevue. It appears that he requires considerable physical assistance. He is confronted with numerous challenges. He is undergoing a variety of examinations. “Health-wise, he is something of a train wreck,” Mr. Aidala remarked.
There was no prompt response from the hospital to a request for comment.
Mr. Aidala stated that his physical health is his only concern and that he is still “sharp as a tack” mentally.
Winestein has a long history of cardiovascular disease, diabetes, sleep apnea, and eye disorders.
Following his incarceration at the Mohawk Correctional Facility in Oneida County, upstate New York, since 2023, he was transferred to the Rikers Island detention complex on Friday, situated along the East River in The Bronx.
“He received poor treatment.” Mr. Aidala stated, “They refused to provide him with even a sip of water, food, or a bathroom break.”
He is an ailing 72-year-old gentleman.
According to Frank Dwyer, a New York City Department of Corrections spokesperson, Harvey Weinstein continues to be detained at Bellevue Hospital.
Since 2020, the infamous producer has been incarcerated; however, on Thursday, his initial conviction for rape was reversed by the New York Court of Appeals.
Following the pivotal trial in New York in 2020, he was convicted of sexually assaulting former production assistant Mimi Haley in 2006 and raping former aspiring actress Jessica Mann in 2013. Currently, he is serving a 23-year sentence for these offences.
The highest court of the state determined that the trial judge exhibited prejudice against Weinstein through “egregious” improper judgements, such as permitting women to testify regarding allegations that did not pertain to the case.
The ruling by the majority of the court, which was 4-3, deemed it “an abuse of judicial discretion to allow unsubstantiated accusations of misconduct to stand.”
Mr. Aidala stated that the verdict was favourable for the defendant and every American who is accused of a crime, “regardless of their popularity or unpopularity.”
He stated that one cannot convict an individual on the basis of their complete life.
More witnesses cannot be permitted to testify against the defendant than are charged against the defendant.
One hundred years of legal precedent cannot be discarded simply because an individual is controversial.
Weinstein continues to be incarcerated in spite of the recent ruling on appeal, given that he was found guilty of an additional rape charge in Los Angeles in 2022. In recognition of this offence, he received a sixteen-year penitentiary term.
District attorney of Manhattan Alvin Bragg, who is currently engaged in a hush money trial involving former president Donald Trump, will now make the determination regarding whether or not to retry the 2020 conviction of Harvey Weinstein.
“We will do everything in our power to retry this case, and we remain steadfast in our commitment to survivors of sexual assault,” a Mr. Bragg spokesperson wrote in an email.
Weinstein is scheduled to appear in Manhattan Criminal Court on Wednesday at 2:15 p.m. (local time) for a hearing that, assuming the retrial proceeds, will establish a schedule for future appearances.
Former Manhattan assistant district attorney and Northwestern University Pritzker School of Law professor Deborah Tuerkheimer stated that the likelihood of a second trial will depend on the women who would be required to testify once more and endure the ordeal of a retrial.
She stated, “I believe this will ultimately depend on whether or not they perceive it as something they desire to do and are capable of doing.”
