A customer is filing a lawsuit against the chocolate behemoth Hershey, alleging that the Halloween-themed peanut butter treats failed to correspond with their packaging.
Cynthia Kelly, a resident of Florida, asserts that she purchased the holiday candies due to her admiration for their “artistic designs.”
The individual’s expenditure at an Aldi supermarket was motivated by the “cute looking” eyes and mouth depicted on the containers of the peanut butter pumpkins, which totaled $4.49 (£3.52).
Upon opening the bag, she discovered that not only were the facial features absent, but there were also no engravings.
The chocolate conglomerate is indicted for “materially misleading” in her class action lawsuit. The lawsuit seeks at least $5 million (£3.9 million, or 1.1 million packages of peanut butter pumpkins).
It further states that numerous consumers have been deceived and misled by the images on the product packaging.
