Damages are sought on behalf of all Florida residents who purchased Reese’s peanut butter pumpkins, peanut butter bats, peanut butter footballs, and a variety of Christmas-themed peanut butter snowmen, stockings, and bells.

A customer is filing a lawsuit against the chocolate behemoth Hershey, alleging that the Halloween-themed peanut butter treats failed to correspond with their packaging.

Cynthia Kelly, a resident of Florida, asserts that she purchased the holiday candies due to her admiration for their “artistic designs.”

The individual’s expenditure at an Aldi supermarket was motivated by the “cute looking” eyes and mouth depicted on the containers of the peanut butter pumpkins, which totaled $4.49 (£3.52).

Upon opening the bag, she discovered that not only were the facial features absent, but there were also no engravings.

The chocolate conglomerate is indicted for “materially misleading” in her class action lawsuit. The lawsuit seeks at least $5 million (£3.9 million, or 1.1 million packages of peanut butter pumpkins).

It further states that numerous consumers have been deceived and misled by the images on the product packaging.

In her argument, Ms. Kelly not only references the Halloween candies but also mentions a football-themed peanut butter product. This product lacks the laces depicted on the packaging.

Her Tampa-filed lawsuit also makes allusion to a number of YouTube videos.

She is pursuing compensation for individuals residing in Florida. They have purchased Reese’s peanut butter pumpkins, peanut butter bats, peanut butter footballs. And a variety of Christmas-themed peanut butter snowmen, stockings, and bells.
